A federal judge ruled that Elon Musk and his Department of Government Efficiency (DOGE) likely violated the Constitution by shutting down the U.S. Agency for International Development (USAID). Judge Theodore D. Chuang of the U.S. District Court for the District of Maryland found that Musk acted as a U.S. officer without being adequately appointed by President Trump, violating the Constitution’s appointments clause.

The judge agreed with a group of unnamed aid workers who filed a lawsuit contending that Musk’s rapid assertion of power over executive agencies was unconstitutional. Judge Chuang ordered that agency operations be partially restored, directing Musk’s team to reinstate email access to all USAID employees and submit a plan for employees to reoccupy a federal office from which they had been barred. The ruling prohibits Musk’s team from engaging in any further work related to the shutdown of USAID without the express authorization of a USAID official with legal authority.

However, given that most of the agency’s workforce and contracts had already been terminated, the immediate effect of the judge’s ruling remains unclear. This decision is the latest setback to the Trump administration’s efforts regarding USAID.

Previously, a judge determined that President Trump overstepped his constitutional authority by halting almost all spending on foreign aid administered by USAID as part of his plan to abolish the agency. Organizations have also filed actions against the administration for ordering USAID employees to destroy documents and sought a summary judgment to immediately block the administration from closing down USAID. USAID, one of the Trump administration’s primary targets, has seen 83% of its contracts cut, and the agency moved under the State Department.
