A federal court in California has issued a significant decision in the ongoing copyright case between music publishers and the artificial intelligence company Anthropic. The music publishers, including Concord, ABKCO Music & Records, and Universal Music, sought an injunction to bar Anthropic from using song lyrics to train its AI models, which power its chatbot. The publishers filed the suit in October 2023, claiming that Claude, Anthropic’s AI, produced responses that included lyrics identical or nearly identical to copyrighted songs.
They argued that this use of their songs does not qualify as fair use under U.S. copyright law. U.S. District Judge Eumi Lee ruled against the immediate injunction. The court found that the injunction’s scope was not clearly defined and could not be enforced appropriately, as the publishers had presented a list of 500 songs allegedly used by Anthropic but admitted that the list was “illustrative and non-exhaustive.”
Anthropic expressed satisfaction with the ruling.
Early ruling favors Anthropic in case
A spokesperson for the company stated, “We are pleased that the court did not grant the plaintiffs’ disruptive and amorphous request for interim relief in this case. We look forward to explaining why using copyrighted material for training large language models aligns with fair use principles under copyright law.
Despite this setback, representatives of the music publishers remain optimistic.
“Despite the Court’s narrow ruling, we remain very confident in our case against Anthropic more broadly,” a representative stated. The publishers highlighted that Anthropic had already agreed to measures aimed at preventing the inclusion of infringing outputs, a critical aspect of their broader legal strategy. As the case unfolds, it will continue to address the broader legal and ethical questions surrounding using copyrighted materials in training artificial intelligence.
The question of fair use remains unresolved, but Judge Lee ruled that if proven, any harm could potentially be mitigated financially.
